I. General rules

1.1 Your use of the portal network of LAGUNA-TOURS.COM/DINEVIERSORT.BG, the
software applications and the electronic tour-operator services, referred to herein as Services and is
subject to regulation, in accordance with the terms and conditions of this legally binding
arrangement between you and the company LAGUNA TOURS Ltd , which is the same as DINEVI
RESORT.

1.2 The use of the LAGUNA-TOURS.COM/DINEVIERSORT.BG platform and the e-services
therein is considered to constitute a consent and acceptance of these Terms and Conditions.

1.3 Each and every newly introduced functionality or improvement to the e-services provided,
including the creating/adding new web resources to the portal network of LAGUNATOURS.COM/DINEVIERSORT.BG,
shall also be governed by these conditions of use.

1.4 The services, provided through LAGUNA-TOURS.COM/DINEVIERSORT.BG, are available
through (but not limited by) the World Wide Web, 3G/GPRS/HDA and through Company’s own
hybrid application for mobile telephones, based on the iOS and Android operating systems. These
General Terms and conditions are applicable each and every time you access the LAGUNATOURS.COM/DINEVIERSORT.BG
platform, its tools and services, irrespective of the design,
operating system, browser type and the protocol of access.

1.5 Тhe LAGUNA-TOURS.COM/DINEVIERSORT.BG platform (and its portal network) can be
used to provide electronic services, offered and maintained by third parties, partners and legal
entities in contractual relations with Laguna Tours Ltd.

1.6 A partner is each and every legal entity, having permanent contractual relations with Laguna
Tours Ltd and entitled to provide electronic services to the various types of users.

1.7. All apartments offered for reservations on the website LAGUNA-TOURS.COM/DINEVIERSORT.BG
are privately owned by legal or physical entities, with whom Laguna Tours Ltd has contractual
relationship and performs property management services and rental income optimization through
offering the apartments for holiday rentals.

1.8. The apartment photographs on the website LAGUNA-TOURS.COM/DINEVIERSORT.BG and the
virtual tour on the website are visualizations of typical apartments. The photographs do not
guarantee that all apartments are furnished the same way or that actual accommodation will be
exactly there. The photographs and virtual tour are useful tools to show the room characteristics –
the distribution of rooms, the standard of furnishing, the views and accessibility.

II. Changes to the terms of use

2.1 LAGUNA TOURS LTD may change, add or remove parts of these Terms of Use at any time. Any
and all changes, reflected in these Terms of Use, become effective immediately after their
publication.

III. PRIVACY NOTICE

Data privacy is of high importance for LAGUNA TOURS LTD and we want to be open and transparent
with our processing of your personal data.

We therefore have a policy setting out how your personal data will be processed and protected.

Who is the controller of your personal data?
The company, LAGUNA TOURS Ltd, is the controller of the personal data you submit to us and
responsible for your personal data under applicable data protection law.

Where do we store your data?
The data that we collect from you is stored in our offices in St.Vlas, Bulgaria, within the EU, on paper
data carrier and on electronic data carriers (database, electronic e-mails)

Who can access your data?
We never pass on, sell or swap your data for marketing purposes to third parties outside the
company. Data that is forwarded to third parties, is only used to provide you with our services. You
will find categories of third parties under every specific process below.

What is the legal ground for processing?
For every specific process of personal data we collect from you, we will inform you whether the
provision of personal data is statutory or required to enter a contract and whether it is an obligation
to provide the personal data and possible consequences if you choose not to.

What are your rights?

Right to access:
You have the right to request information about the personal data we hold on you at any time. You
can contact LAGUNA TOURS Ltd and we will provide you with your personal data via e-mail.

Right to portability:
Whenever LAGUNA TOURS Ltd processes your personal data, by automated means based on your
consent or based on an agreement, you have the right to get a copy of your data transferred to you
or to another party. This only includes the personal data you have submitted to us.

Right to rectification:
You have the right to request rectification of your personal data if the information is incorrect,
including the right to have incomplete personal data completed. If you have a Laguna account or
Club membership you can edit your personal data under your account and membership pages.

Right to erasure:
You have the right to erase any personal data processed by LAGUNA TOURS ltd at any time except
for the following situations:

*you have an ongoing matter with Customer Service
*you have an open holiday reservation request and you have not received accommodation yet
*you have an unsettled debt with LAGUNA TOURS LTD, regardless of the payment method
*if you are suspected or have misused our services within the last four years
*your debt has been sold to a third party within the last three years or one year for deceased
customers
*your credit application has been rejected within the last three months
*if you have been accommodated in our apartments, we will keep your personal data in connection
to your transaction for book-keeping purposes

Your right to object to processing based on legitimate interest:
You have the right to object to processing of your personal data that is based on LAGUNA TOURS
LTD’s legitimate interest. LAGUNA TOURS LTD will not continue to process the personal data unless
we can demostrate legitimate grounds for the process which overrides your interest and rights or
due to legal claims.

Your right to object to direct marketing:
You have the right to object to direct marketing, including profiling analysis made for direct
marketing purposes.
You can opt out from direct marketing by the following means:
* following the instruction in each marketing emails
* by editing the settings of your LAGUNA TOURS LTD account

Right to restriction:
You have the right to request that LAGUNA TOURS LTD restricts the process of your personal data
under the following circumstances:
* if you object to a processing based LAGUNA TOURS LTD’s legitimate interest, LAGUNA TOURS LTD
shall restrict all processing of such data pending the verification of the legitimate interest.
* if you have claim that your personal data is incorrect, LAGUNA TOURS LTD must restrict all
processing of such data pending the verification of the accuracy of the personal data.
* if the processing is unlawful you can oppose the erasure of personal data and instead request the
restriction of the use of your personal data instead
* if LAGUNA TOURS LTD no longer needs the personal data but it is required by you to defend legal
claims.

How can you exercise your rights?
We take data protection very seriously and therefore we have dedicated customer service personnel
to handle your requests in relation to your rights stated above. You can always reach them at

Data Protection Officer:
We have appointed a Data Protection Officer to ensure that we continuously process your personal
data in an open, accurate and legal manner. You can contact our Data Protection Officer at

Right to complain with a supervisory authority:
If you consider LAGUNA TOURS LTD to process your personal data in an incorrect way you can
contact us. You also have the right to raise a complaint to a supervisory authority.

Updates to our Privacy Notice:
We may need to update our Privacy Notice. The latest version of the Privacy Notice is always
available on our website. We will communicate any material changes to the Privacy Notice, for
example the purpose of why we use your personal data, the identity of the Controller or your rights.

3.1. Online Purchase Privacy Notice

Why do we use your personal data?
We will use your personal data to manage your online holiday reservations by processing your orders
and returns via our online services and send you notifications of reservation status or in the event of
any problems with the reservation.We will use your personal data to manage your payments.
We will also use your data in order to handle complaints and warranty matters for reservation
conformity.
Your personal data is being used to identify you and to validate your legal age for reservations
online.
Your personal data will be provided to third parties for enabling your accommodation in the
apartment complex and for making airport transfers to and from your apartment.

What types of personal data do we process?
We will process following categories of personal data
* contact information such as name, date of birth, address, e-mail address and telephone number
* Passport data, such as full name, passport number, date of issue, date of validity, country, personal
number (for registration upon check-in and for visa hotel confirmations only)
* payment information and payment history
* credit information
* reservation information
If you have a LAGUNA TOURS LTD account or are a LAGUNA TOURS LTD Club member we will also
process your personal data submitted in relation to the account or membership such as
* account or membership ID
* reservation history

Who has access to your personal data?
Your personal data that is forwarded to third parties, is only used to provide you with the services
mentioned above.

Please be aware that many of these recipient companies have an independent right or obligation to
process your personal data.

What is the legal ground to process your personal data?
The data is processed in accordance with Regulation EU/ №2016/679 from April 27, 2016. The
processing of your personal data is necessary for LAGUNA TOURS LTD to fulfil the service of
managing and delivering the order to you.

How long do we save your data?
We will keep your data as long as you are an active customer.
For customers with an account or Club membership we will keep your personal data for 36 months
after your last purchase.
For individual customers with e-mail/telephone reservations we will keep your personal data for 6
months after your last reservation with us.

3.2. Direct Marketing Privacy Policy

Why do we use your personal data?
We will use your personal data to send you marketing offers, information surveys and invitations
through e-mails, text messages, phone calls and postal mail.

In order to optimise your experience of LAGUNA TOURS LTD we will provide you with relevant
information, recommended products, send you reminders of products left in your shopping bag and
send you personalised offers. All these great services are based on your previous purchases, what
you have clicked on and information you have submitted to us.

What types of personal data do we process?
We will process following categories of personal data
* contact information such as e-mail address, telephone number and postal code
* what products and offers you have clicked on

If you have a LAGUNA TOURS LTD account or are a Club member we will also process your personal
data submitted in relation to the account and membership such as
* name
* age
* shopping history
* how you navigated and clicked on the site

Who has access to your personal data?
Data that is forwarded to third parties is only used to provide you with the service mentioned above.
We never pass on, sell or swap your data for marketing purposes to third parties outside the LAGUNA
TOURS LTD group.

What is the legal ground to process your personal data?
The processing of your personal data is based on your consent when you agree to direct marketing.

Your right to withdraw your consent:
You have the right to withdraw your consent for the processing of your personal data at any time and
also object to direct marketing.

When you do so, LAGUNA TOURS LTD won’t be able to send you any further direct marketing offers
or information based on your consent.

You can opt out from direct marketing by the following means:
* following the instruction in each marketing post
* by editing the settings of your LAGUNA TOURS LTD account

How long do we save your data?
We will keep your data for direct marketing until you withdraw your consent.
For e-mail marketing we will consider you an inactive customer if you haven’t opened an e-mail
within the last year. After this time period your personal data will be deleted.

3.3. Customer Service Privacy Notice

Why do we use your personal data?
We will use your personal data to manage your queries, to handle complaints and warranty matters
for products and technical support matters through e-mail, our chat function, telephone and
through social media.

We may also contact you if there is a problem with your reservation request.

What types of personal data do we process?
We will process any data you provide to us, including the following categories

* contact information such as name, e-mail address and telephone number
* passport data such as name, birth date, date of issue, country, passport number
* payment information and payment history
* credit information
* reservation information
* account or member number
* all correspondance in the matter

Who has access to your personal data?
Data that is forwarded to third parties, is only used to provide you with the services mentioned
above.

What is the legal ground to process your personal data?
The processing of your personal data is based on H&M:s legitimate interest.

How long do we keep your data?
We will keep your data for 1 year after the last check-out date from our apartments.

In case of complaints during your stay your personal data will be saved for 4 years after your last
check-out date.

Your right to object to processing based on legitimate interest:
You have the right to object to the processing of your personal data that is based on LAGUNA TOUR’s
legitimite interest. LAGUNA TOURS will not continue to process the personal data unless we can
demostrate a legitimate ground for the process which overrides your interest and rights or due to
legal claims.

IV. Terms and conditions for ordering services

4.1 Terms and conditions for online reservations
Each and every reservation on LAGUNA-TOURS.COM/DINEVIERSORT.BG web sitе is considered an act
(order) for purchasing the respective accommodation and/or additional services.

4.2. For online reservation of accommodation via the platform LAGUNATOURS.COM/DINEVIERSORT.BG
the Customer selects the period of stay, complex, apartment type,
price offer and/or additional services. The Customers makes online payment of the selected services
via his debit/credit card, of the full amount or partial amount, depending on the terms of
reservation.
After online payment of the reservation the Customer receives via e-mail a link to the same
reservation for future amendments or cancellations, which will be possible or valid depending on the
applicable reservation terms.

4.3. For reservation of accommodation via the request form on the platform LAGUNATOURS.COM/DINEVIERSORT.BG
the Customer fills in and submits the dedicated request form.
In response to the request, the Customer receives an e-mail with information concerning the specific
request: the availability in the period, type and number of rooms, food board, additional services and
payment terms.
Before making the payment the Customer can change some or all of the requested services. After
submitting the form with the final choice of services The Customer will receive a new e-mail with the
new reservation details.
It is the responsibility of the Customer to check his /her reservation and to monitor the compliance
of all the parameters requested by him and to pay the full price charged for the service, within 48
hours of e-mail receipt, by one of the payment methods described below.

4.4. If the reservation is not paid within 48hours of e-mail receipt, the same reservation is considered
not valid and is automatically cancelled. The Customer will not receive a separate cancellation e-mail.

4.5. After receiving the payment the Customer receives on his e-mail address the full details of
reservation with its reference number. LAGUNA TOURS Ltd will send the invoice of the reservation to
the same-mail address.

V. PRICES AND PAYMENT

5.1. The prices on LAGUNA-TOURS.COM/DINEVIERSORT.BG ’s website are gross, including
9% or 20% VAT, depending on the type of service, and resort tax. NO additional fees or charges will
be added on top of the price, regardless of the payment method.

5.2. The total amount, payable by the customer is calculated automatically, depending on the
number of days, the number of adults and children and on the current price offer for the respective
hotel/complex.

5.3. LAGUNA TOURS Ltd preserves the right to change the prices and the special offers on its
platform LAGUNA-TOURS.COM/DINEVIERSORT.BG, depending on the demand and the
current availability. For reservations already confirmed and paid, the price will not change, despite
of the new price offers introduced.

5.4. LAGUNA TOURS Ltd. does not require initial deposit from the Customers against the protection
of the property in the apartment, but damages or lack of property (missing/removed items)
occurred during the stay and as a result of the Customer’s faulty behavior must be paid according to
a separate price list available at Dinevi Resort’s main reception-desk, in Leva or Eur.

VI. POSSIBLE PAYMENT METHODS
The payment can be performed, using one of 2 different methods

6.1 Electronically, using a debit or credit card
We accept payment by Visa, Visa Electron and MasterCard cards. If you choose this payment
method, the Customer can pay immediately with debit/credit card via the certified virtual POS
terminal on LAGUNA-TOURS.COM/DINEVIERSORT.BG (maintained by our servicing bank Raiffeisen
Bank AD). A secured virtual page for online payments is opening, where the Customers fills in himself
his Card information – number of card, validity and cvc code. With making the payment the
reservation is fully guaranteed and the paid amount can be refunded according to the cancellation
terms described in the reservation and here in the next lines. No additional fees are due in case of
debit/credit card payments.

At the time of online reservation, the amounts entered will be automatically withdrawn from the
Customer’s Card upon completion of the payment process.

6.3 Using a bank transfer
Payment of the full amount must be made at the latest within the time limit specified in the e-mail
with the specific offer, and the reservation reference must be entered in the grounds for payment
Once the payment has been made, it is necessary to send a copy of the payment order by e-mail to
reservations@dineviresort.bg

VII. RESERVATONS AND ACCOMODATON, CANCELLATIONS AND CHANGES

7.1 RESERVATIONS AND ACCOMODATION

7.1.1 The present General Terms and Conditions oblige LAGUNA TOURS Ltd. to provide the
reservation of the hotel accommodation, paid by the User, under the conditions specified therein.

7.1.2 The ‘Remarks’ field on the online reservation form and the request form is not mandatory for
LAGUNA TOURS Ltd. and any Customer wishes filled in the field will be satisfied only if possible..

7.1.3 For the purpose of the reservation, only persons younger than 12 years at check-in date will be
considered children.

7.1.4 In the event that exceptional circumstances require LAGUNA TOURS Ltd. to change or cancel
the reservation of hotel accommodation, paid by the User, LAGUNA TOURS LTD shall notify the
Customer immediately and the User shall have the right to choose one of the following alternatives:
a) to accept accommodation in a hotel of the same or a higher category and, if not possible, in a
lower category accommodating, with reimbursement of the difference between the service paid
and the actual price;
b) to cancel the reservation. In case of cancellation of the reservation due to changes made by
LAGUNA TOURS Ltd., the amount paid by the Customer is subject to a full refund under the terms
and conditions set out below.

7.2. Requests for cancellation of paid reservations by the Customer are accepted only if they are
made in writing — by e-mail to reservations@dineviresort.bg

7.2.1 In the event of cancellation by the Customer of an already paid reservation or in case of Noshow,
LAGUNA TOURS Ltd shall consider the request for repayment of the amount paid by the
Customer upon written request by e-mail to reservations@dineviresort.bg or by fax +359 554
68791. The repayment request must contain: Customer name and surname, reservation number,
cancellation reasons, bank details (bank, account number to be transferred, account holder’s name )
In this case, the Customer has the right to receive the refund, after deduction of the cancellation fee
(if applicable), within 14 (fourteen) working days from the date of the written request.

7.2.2 Certain special offers and packages, such as early booking and last minute offers, are not
subject to refund in case of cancellation or No-show, which terms are explicitly mentioned in a
prominent place in the offers themselves.

7.2.3 In the event of cancellation in a period for which penalties have already taken effect, the
amount paid on the reservation subject to cancellation shall be refunded to the User after deduction
of the penalty amount due and after deduction of the costs incurred for the transfers of funds under
this booking. The user receives an invoice for the amount of the charge.

7.3 Cancellation fees

7.3.1 Cancellation fees for prepaid reservations

7.3.1.1. Free cancellation can be made up to 14 days before the arrival date, when the reservation is
made on the ‘Summer Rate’ tariff. Cancellations less than 14 days before arrival are made with 30%
fee calculated on the full reservation amount. In case of No-show there is 30% fee.

7.3.1.2 Cancellations with 100% fee are made in all cases when the reservation is on the ‘Welcome
Rate’ tariff, regardless of the time of cancellation. If the customer modifies the same reservation
(instead of cancelling) then the price will be re-calculated, with no refund of any overpaid amount. In
this case Laguna Tours Ltd may add additional services in favor of the customer, depending on the
availabilities.

7.3.1.3 Cancellations of confirmed and prepaid reservations — special offers, package rates and lastminute
rates — are made according to the terms for each of them, clearly described on the relevant
offer page.

7.3.1.4 Cancellations of confirmed and paid additional services, ex. Breakfast, airport transfer, baby
cot, can be made any time before arrival with 100% refund of the paid amount, less the bank
charges. Instead of a refund, the amount can be used to pay the hotel accommodation on the same
reservation.

7.4 Modification of prepaid reservations

7.4.1. Requests to modify paid reservations by the customer are accepted only if they are made in
writing – via e-mail to reservations@dineviresort.bg

7.4.2 LAGUNA-TOURS.COM/DINEVIERSORT.BG team will make everything possible to satisfy the
Customer’s request, but do not guarantee the actual modification. Modifications can be made only if
the availability allows them and become valid after LAGUNA-TOURS.COM/DINEVIERSORT.BG written
confirmation sent to the Customer’s e-mail.

7.4.3. In case of a modification of a paid reservation, there may be changes in the price of the
reservation, subject to the new conditions. In this vase the modification becomes valid only if the
additional cost is paid by the Customer.
